Legal terms and conditions for using EUGameHost services.

By accessing the website at EUGameHost and/or ordering, using, renewing, or continuing to
use any service provided by EUGameHost, you agree to be bound by these Terms of Service, all
applicable laws and regulations, and accept responsibility for compliance with any
applicable local laws.
If you do not agree with any of these terms, you must not use this website or any EUGameHost
services.
1. Definitions
"Website" refers to EUGameHost.
"Services" refers to any hosting services, including shared game servers,
virtual private servers, virtual dedicated services, dedicated servers, and related
offerings provided by EUGameHost.
"User" refers to any individual or entity accessing or using the Website or
Services.
"Billing Cycle" refers to the selected recurring service period, including
but not limited to monthly, bi-monthly, quarterly, or yearly renewal periods.
2. Use License
Permission is granted to temporarily download one copy of the materials on EUGameHost's
website for personal, non-commercial transitory viewing only. This is the grant of a
license, not a transfer of title.
Under this license, you may not modify or copy the materials.
Under this license, you may not use the materials for any commercial purpose or public
display.
Under this license, you may not attempt to decompile or reverse engineer any software
contained on EUGameHost's website.
Under this license, you may not remove any copyright or other proprietary notations from the
materials.
Under this license, you may not transfer the materials to another person or mirror the
materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may
be terminated by EUGameHost at any time.
Upon termination of this license, you must destroy any downloaded materials in your
possession whether in electronic or printed format.
3. Disclaimer
The materials on EUGameHost's website are provided on an 'as is' basis. EUGameHost makes no
warranties, expressed or implied, and disclaims all other warranties including implied
warranties of merchantability, fitness for a particular purpose, or non-infringement of
intellectual property.
EUGameHost does not warrant or make any representations concerning the accuracy, likely
results, or reliability of the use of the materials on its website or on any linked sites.
4. Limitations of Liability
To the maximum extent permitted by applicable law, EUGameHost and its suppliers shall not be
liable for any direct, indirect, incidental, special, or consequential damages (including
damages for loss of data, loss of profit, or business interruption) arising out of the use
or inability to use any service provided by EUGameHost.
EUGameHost accepts no liability for any loss of data, files, or content stored on or
associated with any service, whether arising from suspension, termination, system error,
hardware failure, human error, automated processes, or any other cause.
Users are solely responsible for maintaining their own off-platform backups of all data and
content at all times.
Because some jurisdictions do not allow limitations on implied warranties or limitations of
liability for consequential or incidental damages, these limitations may not apply to you in
full.
5. Accuracy of Materials
The materials appearing on EUGameHost's website could include technical, typographical, or
photographic errors.
EUGameHost does not warrant that any of the materials on its website are accurate, complete,
or current.
EUGameHost may make changes to the materials contained on its website at any time without
notice and does not make any commitment to update them.
6. Refunds & Payments
All game servers, virtual private servers, and dedicated servers are to be paid for in
advance.
Failure to keep up monthly payments on your server can result in suspension and ultimately
deletion of your server(s) and all associated data.
EUGameHost operates automated billing and service lifecycle systems. It is the customer's
responsibility to ensure payments are made on time and that billing details are kept up to
date.
If you cancel a subscription, please also cancel your PayPal subscription separately, as it
does not always auto-cancel. EUGameHost will refund any overpayments if the cancellation
script fails.
If you raise a payment dispute, your service may be suspended whilst the investigation is in
progress.
No personal credit or debit card details are retained by EUGameHost directly.
By renewing your service, you agree to continue your subscription for the selected billing
period. All service renewals are strictly non-refundable.
On new orders (non-dedicated servers), we offer a 48-hour cooling off period in which you
are entitled to a full refund. After this window, refunds can be denied.
All dedicated servers are treated as a business-to-business transaction and are
non-refundable due to their reseller nature.
Invoice charges are placed 2 days before the actual due date. If payment is not received
within 2 days of the final due date, the service is suspended and a late fee of up to 10% is
automatically applied. This only applies to services that are still active.
We reserve the right to refuse the renewal of services for any reason.
Claiming a service free trial waives your 48-hour right to refund after payment should you
choose to take up the service after the trial expires.
Services within the 48-hour refund window will be deemed ineligible for refunds if employed
for illegal or malicious activities.
7. Fair Use
By agreeing to our Terms and Conditions, you acknowledge and accept our Fair Use Policy,
which is detailed on our website.
This policy outlines the guidelines and limitations applicable to our services.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the
United Kingdom.
You irrevocably submit to the exclusive jurisdiction of the courts of the United Kingdom.
9. Abuse and Threats
Harassment: Persistent or severe harassment of our staff or other users,
including unwanted or threatening communications, will not be tolerated.
Threats: Any threats of violence or harm directed at our staff, users, or
their property will result in immediate action, including possible suspension or termination
of services.
Discrimination: Abusive behavior based on race, gender, sexual orientation,
religion, nationality, or any other protected characteristic is prohibited.
False Reporting: Making false reports or accusations against our staff or
other users with intent to damage their reputation or disrupt services is not permitted.
Warning: A warning may be issued to the offending user, detailing the
nature of the abuse and the necessary corrective actions.
Suspension: Services may be temporarily suspended if the behavior continues
or if the initial warning is ignored.
Termination: Persistent or severe abuse will result in permanent
termination of services and access to the Website or Services may be permanently revoked.
Legal Action: In cases involving illegal activities or threats of violence,
EUGameHost reserves the right to involve law enforcement and pursue legal action.
10. User Accounts and Security
Users are responsible for maintaining the confidentiality of their account login information
and for all activities that occur under their account.
Users must notify EUGameHost immediately of any unauthorized use of their account or any
other breach of security.
EUGameHost is not liable for any loss or damage arising from a user's failure to protect
their account information.
11. Service Availability and Maintenance
EUGameHost strives to ensure that its services are available 24/7/365 but does not guarantee
uninterrupted availability.
Scheduled maintenance may occur from time to time and EUGameHost will provide notice of such
maintenance whenever possible.
Users acknowledge that downtime or service interruptions can occur and agree that EUGameHost
is not liable for any losses incurred due to such interruptions.
12. Data Privacy and Protection
EUGameHost respects user privacy and is committed to protecting personal data.
For detailed information on how user data is collected, used, and protected, please refer to
our Privacy Policy.
13. Termination of Service
EUGameHost reserves the right to terminate or suspend any user's access to services if the
user violates these terms, engages in any prohibited activity, or for any reason deemed
necessary by EUGameHost, without obligation to provide a refund.
Upon termination or suspension of a service for any reason, including but not limited to
non-payment, cancellation, policy violation, or abuse, all data associated with that service
will be permanently and immediately deleted as part of our automated service lifecycle
process. There is no grace period or retention window after termination.
This deletion includes all files, configurations, and any backup slots associated with the
service. No data is retained by EUGameHost after a service is deleted.
EUGameHost does not guarantee the availability of any data following service termination or
suspension.
Users may terminate their services by following the cancellation process in our
client/billing area.
14. Dispute Resolution
Any disputes arising from or related to these Terms of Service shall be resolved through
binding arbitration in accordance with the rules of the arbitration institution selected by
EUGameHost.
In the event that arbitration is not suitable, disputes shall be resolved by the competent
courts in the United Kingdom.
15. Prohibited Conduct
Users are prohibited from engaging in any activities that violate any laws or regulations.
Users must not infringe on the rights of others or result in unauthorized access to or use
of third-party systems.
Users must not disrupt or interfere with the operation of the Website or Services.
Users must not distribute malicious software or other harmful code.
16. Links to Third-Party Sites
The EUGameHost website may contain links to other websites or services that are not owned or
controlled by EUGameHost.
We have no control over, and assume no responsibility for, the content, privacy policies, or
practices of any third-party websites or services.
EUGameHost shall not be responsible or liable, directly or indirectly, for any damage or
loss caused by or in connection with the use of or reliance on any third-party content or
services.
We strongly advise you to read the terms and conditions and privacy policy of any
third-party website or service that you visit.
17. Force Majeure
EUGameHost shall not be held liable for any failure to perform its obligations under these
Terms of Service if such failure is due to events beyond its reasonable control.
This includes but is not limited to natural disasters, acts of war, power failures, internet
or network outages, or other emergencies.
18. Support Response Time
We aim to respond within 2 hours of receiving a ticket, though our usual response times are
often quicker.
During busy periods, it may take up to 72 hours to receive a response.
Repeatedly submitting tickets in quick succession will put your support request to the back
of the queue.
Continued misuse of the ticket system will result in a temporary or permanent ban from
accessing support.
19. Server Backups & Data Loss
Where backup functionality is provided as part of a service, those backups are made
available as a convenience feature within the active service environment only. Backups are
part of the service and exist only for as long as the service remains active.
Backups are permanently deleted alongside the service when it is terminated or
suspended, for any reason. EUGameHost does not retain independent copies of customer
backups after a service is deleted.
EUGameHost does not actively manage, monitor, or administer customer backups on the
customer's behalf. Backups are not directly accessible by EUGameHost staff and
are not guaranteed to be available at any given time.
Shared Game Servers include a minimum of 5 backup slots (excluding free
tier services). These backups are managed within the service panel by the customer, are not
controlled or restored by EUGameHost, and are deleted automatically when the service is
terminated.
Virtual Private Servers and Virtual Dedicated Servers include a minimum of
2 snapshot backups. These are provided as a convenience, are not guaranteed to be available
or restorable at all times, and are deleted when the service is terminated.
Dedicated Servers: EUGameHost does not provide backups of any kind for
dedicated servers. Customers are solely responsible for all backup management.
EUGameHost accepts no liability for loss of data, files, or content under any circumstances,
including but not limited to service suspension or termination, hardware or software
failure, human error, system error, or automated processes. This applies regardless of
whether backup functionality is included with the service.
All customers are strongly advised to maintain independent, off-platform copies of
all data and content at all times. Reliance solely on any backup feature
provided within the service panel is done entirely at the customer's own risk.
If backups are unavailable, incomplete, or unrestorable for any reason, EUGameHost is not
responsible for any resulting data loss.
20. Rent to Own Dedicated Servers
Rent to Own ("RTO") dedicated servers remain the sole property of EUGameHost until
all payments due under the RTO agreement have been paid in full. No legal,
beneficial, or ownership rights in the server or hardware pass to the customer until the
full RTO term has been completed and all sums owed have been received in cleared funds.
RTO pricing includes an additional charge above standard rental pricing in consideration of
the ownership option, hardware allocation, risk, and administrative costs associated with
the RTO arrangement. This does not give the customer any immediate ownership interest in the
hardware during the payment term.
If an RTO invoice remains unpaid for 7 days after its due date, the
dedicated server may be suspended without further notice.
If an RTO invoice remains unpaid for 14 days after its due date, a
£100 reactivation and administration fee will be applied before the service
can be restored or the RTO agreement can continue.
If an RTO invoice remains unpaid for 28 days after its due date, the
RTO agreement will be automatically terminated. EUGameHost may then cancel
the service, remove the server from the customer's allocation, wipe or reprovision the
system, and return the hardware to stock for resale, redeployment, or rental.
Where an RTO agreement is terminated for non-payment, all amounts paid up to the
date of termination shall be treated as non-refundable charges for server rental,
hardware allocation, service provision, administrative costs, and the RTO arrangement up
to that date. Such payments do not create any ownership entitlement, equity, or
claim over the hardware unless the agreement has been completed in full.
Once terminated for non-payment, the customer forfeits any right to continue,
reinstate, or complete the original RTO agreement unless EUGameHost agrees
otherwise in writing at its sole discretion.
EUGameHost is under no obligation to hold, reserve, or store dedicated hardware for a
customer where an RTO agreement has fallen into arrears.
Any request to pause, defer, or vary an RTO agreement is entirely at the discretion of
EUGameHost and will only be valid if confirmed in writing. EUGameHost is under no obligation
to offer any pause or extension.
